TERMS & CONDITIONS OF “Le 10 – Reflets dans l'Eau”
Hereinafter referred to as “the Owner.”

Definition of the Guest
The “Guest” refers to the individual who made the booking, whose name and surname appear on the booking form. The Guest is deemed to act both on their own behalf and on behalf of all occupants they declared at the time of booking, and is responsible for ensuring that these Terms & Conditions (hereinafter “T&C”) are respected by those occupants.
Any booking, regardless of how it is validated, implies full and unreserved acceptance of these T&C.
SUBJECT AND DESCRIPTION
Article 1 — Subject
These Terms & Conditions govern short-term rentals of the furnished tourist accommodation known as "Le 10 – Reflets dans l'Eau", located at 10 route des Chasseurs, 38110 Saint-Clair-de-la-Tour. Any booking implies full and unreserved acceptance of these T&C.
Article 2 – Description of the property
The property is a standalone house of 127 m² that can accommodate up to 8 people. It includes:
3 bedrooms; 2 bathrooms; a large living area comprising a lounge, dining room and kitchen; a laundry room; a garden; a pond and a mill race; a terrace; a private pool, reserved exclusively for guests staying at Le 10.
Article 3 — Booking and confirmation
A booking becomes effective and final once:
availability has been confirmed;
the total amount has been paid according to the terms indicated at the time of booking;
these T&C have been accepted.
Any booking made via the Owner's website constitutes acceptance of these T&C once the Guest has ticked the box provided for that purpose.
Renting to unaccompanied minors is prohibited.
In the event of a fraudulent booking regarding the Guest's identity or age, the Owner reserves the right to request proof of the Guest's legal age and/or to refuse access to the property, with no refund or compensation.
Article 4 — Duration
The rental period corresponds to the confirmed booking.
The number of guests is that indicated by the Guest at the time of booking.
The number of guests may not be increased without the Owner's prior agreement (possibly subject to an additional charge).
Article 5 — Booking confirmations
All booking terms — length of stay, price, number of guests, applicable payment and cancellation terms — will be those indicated to and accepted by the Guest.
A confirmation email summarising these will be sent to the Guest.
Non-receipt or non-reading of this email, in particular in the event of an incorrect email address entered by the Guest, shall not constitute grounds for disputing these T&C. It is the Guest's responsibility to check that this email has been received and to contact the Owner if no confirmation is received within a reasonable time.
PRICE / PAYMENT / CANCELLATION
Article 6 — Price
Prices are shown in euros, inclusive of all taxes, on the site at the time of booking.
They include: rental of the property; bed linen; bath linen; standard utilities; end-of-stay cleaning.
Any service not mentioned is excluded.
The local tourist tax is not included: it is charged per adult per night, at the rate set by the local authority (subject to change), and is payable upon the Guest’s arrival, in cash only.
Article 7 — Payment terms
Payment terms are indicated when the booking is confirmed, according to the rate plan chosen by the Guest.
The full cost of the stay is payable at the time of booking, or on the payment date specified under the rate plan confirmed by the Guest.
Payment is made electronically, via the site's secure online payment provider.
Article 8 — Cancellation
8-1: By the Guest: Applicable cancellation terms are those specified at the time of booking and accepted by the Guest when confirming it.
They vary depending on the period and length of stay (rate plan).
Regardless of the reason given, any early departure after arrival will not entitle the Guest to any refund, even partial, for the remaining, unused portion of the stay.
Any request to shorten the stay before arrival is treated as a partial cancellation, subject to the cancellation conditions of the rate booked. If the Owner agrees to it, the price is recalculated at the rate applicable to the new length of stay: discounts linked to a minimum length of stay (such as a weekly rate) no longer apply.
The Owner recommends that the Guest take out cancellation insurance.
8-2 By the Owner: In the event of force majeure or an exceptional inability to make the property available, sums paid will be refunded in full, with no further compensation.
Force majeure includes, without limitation: a major incident (fire, significant water damage, natural disaster), an administrative or judicial decision rendering the property unavailable, or any external, unforeseeable and unavoidable event within the meaning of Article 1218 of the French Civil Code.
Article 9 — No-show
If the Guest fails to arrive on the booked date, without any prior notice or communication (email, text message or call), the booking is considered cancelled.
No refund may be claimed: the full cost of the stay remains due and any sums already paid are retained by the Owner.
For multi-night bookings, if the Guest informs the Owner of a delayed arrival on a later day, the booking is maintained under its original terms. Nights not used prior to this delayed arrival are non-refundable.
OCCUPATION OF THE PROPERTY “Le 10, Reflets dans l'Eau”
Article 10 — Nature of the occupancy agreement
The booking is made as a short-term furnished tourist rental, in accordance with Articles L.324-1 et seq. of the French Tourism Code.
It does not, under any circumstances, constitute a residential lease within the meaning of the French law of 6 July 1989, and does not grant the Guest any right to remain on the premises after the agreed period.
The Guest expressly agrees to vacate the property on the agreed date and time.
Remaining on the premises without the Owner's prior agreement will constitute unauthorised occupation, which may give rise to an occupation fee equal to twice the applicable daily rate, without prejudice to any other action.
Article 11 — Arrival / departure
The Guest must inform Le 10 of their arrival time by email or text message no later than the day before their stay.
Standard check-in times are: 3:00pm to 8:00pm.
Standard check-out times are: 7:00am to 11:00am.
These times may be adjusted at the Guest's express request.
Under no circumstances should such a request be considered automatically accepted by the Guest.
Any change of schedule only becomes effective once the Owner has confirmed in writing that it is feasible.
Article 12 — Capacity of the property / number of guests
The number of guests is that indicated by the Guest at the time of booking.
The maximum capacity of Le 10 is 8 people.
Exceeding this capacity may result in immediate termination of the rental, with no refund or compensation.
Article 13 — Expected conduct of the Guest
The Guest agrees in particular to:
Use the property and its equipment in a reasonable, careful manner and in accordance with their intended purpose.
Not exceed the maximum capacity of 8 people.
Not organise unauthorised parties or gatherings.
Comply with these house rules.
Return the property in the condition in which it was provided.
Article 14 — Parties / respect for neighbours
Organising parties, group events, noisy gatherings or events such as stag/hen parties is STRICTLY PROHIBITED in the property and on the grounds.
Failure to comply with this rule will result in immediate termination of the stay as of right, without notice. Occupants must leave the premises immediately, with no entitlement to any refund or compensation, without prejudice to the retention of the full security deposit to cover any nuisance or damage.
The Guest also agrees to respect the peace and quiet of neighbours at all times, in particular by lowering music from 9:00pm onward, and more generally all noise in the evening and at night.
Article 15 — Use of the pool
Use of the pool is reserved EXCLUSIVELY for guests staying at Le 10.
It is open during the summer season only (typically from June to the end of September).
It is open during the daytime. Night-time swimming is prohibited, unless expressly agreed by the Owner.
Children under 12 are not permitted to access the pool unless accompanied by a responsible adult.
Children must remain under the constant supervision of a responsible adult.
Swimming is undertaken entirely at the Guest's own risk.
Consuming alcohol and using glass containers are prohibited near the pool. Plastic cups are provided in the property for this purpose.
Article 16 — Smoking, vaping and drugs
All indoor areas of the property are strictly non-smoking (including e-cigarettes/vaping). This is indicated by a sign on the front door.
In the event of non-compliance, the Guest will be liable for any consequences and costs resulting from smoke or tobacco odours in the property.
These costs may include, in particular, deodorising, deep-cleaning of textiles and additional laundering of linen, as well as, where necessary, the consequences of the property being temporarily unavailable and any resulting loss of rental income due to the inability to re-let it.
A flat-rate fee of €1,000 may be applied to cover the costs and consequences of failing to comply with this prohibition, without prejudice to compensation for any actual loss exceeding this amount. The Owner may claim any additional sum corresponding to a separate or greater loss, provided it can be substantiated.
Possessing or using illegal substances/drugs is strictly prohibited in the property and throughout the grounds. Any such practice will result in the immediate eviction of the occupants, with no refund.
Article 17 — Pets
Pets are not permitted anywhere on the property.
In the event of non-compliance with this prohibition, the Guest will be liable for any resulting consequences and costs, which may include deodorising, deep-cleaning of textiles and additional laundering of linen.
LIABILITY
Article 18 — Guest liability
The person who made the booking is responsible for ensuring that these T&C are respected by all occupants they declared, and is liable for any damage caused by them.
Article 19 — Insurance
The Guest is strongly advised to take out, before their stay:
- holiday liability insurance or a "holiday rental liability" extension, covering any damage they may cause to the property during their stay.
- cancellation insurance, covering the risk of a last-minute inability to travel (see the cancellation section).
Article 20 — Security deposit
A security deposit of €500 is requested from the Guest on arrival.
The security deposit may be provided in cash or by cheque, as agreed with the Owner.
On arrival, the property is handed over to the Guest in perfect condition of cleanliness and working order. Unless the Guest notifies the Owner in writing of any issue within 24 hours of moving in, the property and its equipment are deemed to have been handed over in good condition and in accordance with the description.
It will be returned when the Guest departs, once the property has been checked, provided no damage is found, or within a maximum of 7 days if a more thorough inspection or additional cleaning proves necessary.
In the event of observed damage, deterioration of equipment, loss of keys, or failure to comply with the rules (in particular the smoking or party prohibitions), all or part of the security deposit will be withheld upon presentation of supporting evidence of the cost of repairs.
The security deposit does not limit the Guest's liability.
The Owner may claim the difference where legally justified.
Loss of the property's coded key will incur a flat fee of €250.
GENERAL PROVISIONS
Article 21 — Right of withdrawal
In accordance with Article L.221-28, 12° of the French Consumer Code, accommodation services provided on a specific date or according to a set schedule are not subject to the 14-day withdrawal period applicable to distance sales. Any booking made on the site is therefore firm and final upon acceptance, subject to the cancellation terms set out above.
